Earlier this week, supermodel Heidi Klum announced to People magazine that she split with her boyfriend of three years, art curator Vito Schnabel (he’s a looker, right?).

Turns out, weeks before they split, Vito was was arrested on September 3 at the Burning Man Festival in Nevada for drug possession, according to Us Weekly. Apparently, he was in possession of psychedelic mushrooms — it was Burning Man after all.

While Vito pleaded not guilty to the charges, he is still facing up to five years in prison, according to TMZ.

Reflecting on the breakup, Heidi told People: “I believe that it is important to take time to pause and reflect.”

But a source confirmed that things have been on the rocks long before Vito’s arrest. In fact, The Daily Mail printed photos in June of Vito kissing an unknown brunette, though he said it was a big misunderstanding.

“The claims that have been made are a misinterpretation of an entirely innocent situation,” Vito told Us Weekly at the time. “There is nothing more to this than I was simply saying goodnight to a family friend and we went our separate ways.”

Heidi began the relationship two years after splitting from ex-husband Seal, whom she shares three children with. In a 2015 Entertainment Tonight interview, she said she was “very much in love” with Vito:

“This is just a beautiful bauble from Lorraine Schwartz,” she told ET of the ring on her finger. “I won’t get married again. People always write all these crazy things, but it’s not all true. Don’t always believe what you read in the paper!”
