Sofie Vergara has been in a lawsuit battle against her ex-fiance Nick Loeb over her frozen embryos, but now a Louisiana federal judge tossed the case out, citing that the eggs are citizens of California — where they were conceived.

Page Six points out that “Louisiana is the only state where embryos have legal rights of their own — rather than being considered the belongings of their parents — and Loeb, who wants to be a dad, was trying to ship the embryos there from Beverly Hills.”

Nick was trying to get the eggs, named “Emma” and “Isabella” in court papers, under his custody, saying Sofia abandoned them.
