Another Loss For Kesha In The Legal Battle With Dr. Luke

While Kesha has received tremendous support from fans and many celebrities during her legal battle Dr. Luke, she hasn’t been fairing so well in court. After she was denied the ability to end her contract with Sony earlier this year, the court sided against her again today, dismissing several of her allegations.

Judge Shirley Werner Kornreich rejected the singer’s claim of intentional infliction of emotional distress because of the statute of limitations. The judge also decided Kesha failed to state a claim regarding the alleged incidents of 2005 and 2008, saying:

 “The claims of insults about her value as an artist, her looks and her weight are insufficient to constitute extreme, outrageous conduct intolerable in civilized society.”

The judge shot down Kesha’s claim of gender discrimination as well, saying the singer “failed to plead that any of the alleged discrimination occurred in New York State or City.” When it came to her claim the she was the victim of a hate crime from by Dr. Luke, the judge decided that:

 “Although [Dr. Luke’s] alleged actions were directed to Kesha, who is female,” Kesha (full name: Kesha Rose Sebert) did “not allege that [Dr.Luke] harbored animus toward women or was motivated by gender animus when he allegedly behaved violently toward Kesha. Every rape is not a gender-motivated hate crime.”

The legal battle began in 2014 when Dr. Luke sued Kesha for neglecting to make a third album as required under contract. Kesha then counter-sued the producer, claiming he had physically and sexually abused her for years. Dr. Luke denied all allegations against him, and counter-sued her for defamation of character. According to Variety, the judge ruled that Dr. Luke had not breached their contract since Kesha failed to record the third album. In addition, Dr. Luke’s accountants claimed that Kesha currently owes the producer $1.3 million in unpaid royalties.
