Bethenny Frankel is suing her ex-husband for custody of their 7-year-old daughter after he was charged for harassing and stalking the former reality star.

Bethenny reopened her 2013 case against Jason Hoppy last week, and they’re due in court in January.

Hoppy was arrested in January for showing up at their daughter’s school and warning Frankel, “I will destroy you, you can get all the lawyers you want, you’ve been warned,” according to an NYPD spokesman. He denied the claims.

In 2014, the couple agreed to co-parent.
