In today’s installment of “say what?!” a Texas man is suing his date for texting during a screening of Guardians of the Galaxy Vol. 2. Yep.

According to The Austin American-Statesman, Brandon Vezmar is demanding that his date pay him $17.31, the exact price of the ticket he bought for the 3D screening of the film. After meeting online, the two went to see the flick as a first date, but things ended badly.

Brandon’s petition states, “After the movie started, defendant activated her phone at least 10-20 times in 15 minutes to read and send text messages, in direct violation of the theater’s policy.” He accused the unidentified woman of “adversely affecting the viewing experience” of other moviegoers.

The petition, which was filed to a small claims court, also states, “While damages sought are modest, the principle is important as defendant’s behavior is a threat to civilized society.”

The woman told the paper, “This is crazy. I’m not a bad woman. I just went out on a date.” She claims that she didn’t pay Brandon back because it was a date, and that she only used the phone a few times to respond to a friend that needed her.

It’s probably safe to assume there will not be a second date.
