Instagram is for posting selfies, right?

Instagram queen, Khloe Kardashian, is being sued for posting a photo of herself to her Instagram account. Why? Though the picture was of her, the photo itself belongs to someone else.

According to a lawsuit filed in a California court on Tuesday, the U.K. photo agency, Xposure Photos, is suing Khloe for copyright infringement after she posted their paparazzi photo on her account without their permission, and allegedly removed their credit from the image.

The snapshot was of Khloe and her sister, Kourtney, outside of a Miami restaurant as the two made their way into dinner. It was taken by Manual Munoz and shared on September 14. The lawsuit states that the pic is part of a series taken the day before, belonging to the Daily Mail.

The claim read:

“Defendants’ unauthorized use harms the existing and future market for the original Photograph. Kardashian’s Instagram post made the Photograph immediately available to her nearly 67 million followers and others, consumers of entertainment news–and especially news and images of Kardashian herself, as evidenced by their status as followers of Kardashian–who would otherwise be interested in viewing licensed versions of the Photograph in the magazines and newspapers that are plaintiff’s customers.”

Kinda crazy that someone can take your picture without your consent, but you can’t use it without theirs!

Xposure Photos has requested $25,000 in damages and “all profits derived from the unauthorized use of plaintiff’s Photograph.”
